1. Copyright Ownership

The BayKaar website, mobile application, and all associated services (collectively, the “Service”), including but not limited to the software, source code, design, layout, graphics, logos, icons, images, text, user interface, and all other original content created by BayKaar, are the exclusive property of Equiti Ventures LLC, a Delaware limited liability company, doing business as BayKaar, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

2. Trademarks

“BayKaar,” the BayKaar logo, “Watercooler,” “Wisdom Exchange,” “Busy Minds,” and other product and feature names used on the Service are trademarks or service marks of Equiti Ventures LLC. These marks may not be used in connection with any product or service that is not provided by Equiti Ventures LLC, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits Equiti Ventures LLC.

All other trademarks, service marks, and trade names appearing on the Service are the property of their respective owners. Reference to any third-party trademarks does not constitute or imply affiliation, endorsement, or recommendation.

3. Permitted Use

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial purposes, subject to the Terms of Service. You may not:

  • Copy, reproduce, distribute, publish, display, perform, or create derivative works of any content on the Service without prior written permission from Equiti Ventures LLC.
  • Use any content from the Service for commercial purposes without authorization.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices.
  • Use data mining, robots, scraping, or similar data gathering tools on the Service.
  • Frame or mirror any portion of the Service without our written consent.

4. User-Generated Content

Users retain ownership of their original content posted to the Service (e.g., discussion posts, profile information, comments, reviews). However, by posting content to the Service, you grant Equiti Ventures LLC the licenses described in our Terms of Service.

You are responsible for ensuring that any content you post does not infringe upon the intellectual property rights of any third party. Content that infringes copyright will be removed in accordance with our DMCA policy.

5. Third-Party Content Attribution

The Service may display or link to content from third-party sources, including but not limited to:

  • News Articles: Headlines and brief summaries sourced from public RSS feeds and news aggregators, with links to original sources. All rights to original articles remain with their respective publishers and authors. BayKaar does not claim ownership of third-party news content.
  • Job Listings: Job opportunity information sourced from third-party APIs and public job boards. All rights to job listing content remain with the original posting entities.
  • External Events: Event information sourced from public APIs and community calendars. All rights to event content remain with the original organizers.
  • Book Information: Book titles, author names, and descriptions sourced from public databases for the Book Club feature. All rights to book content remain with the respective authors and publishers.
  • Open Source Software: The Service is built using open source libraries and frameworks, each governed by their respective licenses (MIT, Apache 2.0, BSD, etc.).

If you are a content owner and believe your content is being displayed on the Service without proper authorization, please contact us using the DMCA procedure below.

6. DMCA Policy

6.1 Reporting Copyright Infringement

BayKaar respects the intellectual property rights of others. If you believe that content available on or through the Service infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our designated Copyright Agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
  • Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material (e.g., a URL or description of where the content appears).
  • Your contact information: full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.

6.2 Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our Copyright Agent containing:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or, if outside the United States, the District of Delaware), and that you will accept service of process from the person who provided the original notification.

6.3 Repeat Infringers

In accordance with the DMCA and other applicable law, BayKaar has adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. BayKaar may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
